Domestic Violence Survivors Gain New Unemployment Protection In Michigan

A new protection set to go into effect on July 17, 2026, will allow survivors of domestic abuse in Michigan to collect unemployment if they are forced to leave their job.

Under this new provision, a person who has to leave their job due to domestic violence will be eligible for unemployment benefits as long as they meet all other requirements.

Documentation Accepted For Receiving Unemployment Due to Domestic Violence In Michigan

To qualify, survivors must provide documentation of the abuse. That documentation can be, but is not limited to:

• A restraining order.
• A personal protection order.
• A no-contact order (involving domestic violence).
• A police report documenting domestic violence.
• Documentation showing the perpetrator has been convicted of a domestic violence crime.
• Medical records that document domestic violence.
• A statement (on official letterhead) from a counselor, social worker, health professional, clergy member, shelter worker, or attorney.

While this documentation is required, it will be kept confidential.

You will also have to state that you had to leave your job due to a fear of future domestic violence, a need to address the effects of the abuse, a need to leave work to get services or shelter, a need to move to avoid future domestic violence, or a reasonable belief that leaving your job is needed for your future safety.

Domestic Violence Unemployment Benefits Aren't Exactly New in Michigan

While this move puts this protection permanently into Michigan Unemployment law, it's not exactly new. Previously, there was a temporary rule added during the COVID-19 pandemic, but it had expired.
